SMS Terms and Conditions

These SMS Terms and Conditions govern the text-messaging program operated by Midwest Gold Exchange LLC, doing business as The Gold ATM (“The Gold ATM,” “we,” “us,” or “our”).

1. Program Description

The Gold ATM uses SMS and MMS messaging primarily for one-to-one customer-service conversations.

Customers may initiate a conversation by manually texting our publicly listed business number after finding it on our website, Google Business Profile, advertisements, business listings, or other public materials.

When you text The Gold ATM, you consent to receive replies related to the inquiry you initiated.

Messages may concern:

Items The Gold ATM purchases
Gold, silver, jewelry, diamonds, watches, coins, bullion, handbags, and other eligible items
Our item-evaluation process
Business locations and operating hours
Appointment availability and scheduling
Existing evaluations or purchase transactions
Other customer-service questions related to your inquiry

This program is not used for unsolicited bulk messaging, purchased contact lists, or recurring promotional text-message blasts.

2. Consent

By initiating a text-message conversation with The Gold ATM, you authorize Midwest Gold Exchange LLC, doing business as The Gold ATM, to reply to the telephone number from which you contacted us.

Your consent applies to the conversation or customer-service matter you initiated.

Consent to receive marketing text messages is not a condition of scheduling an appointment, presenting an item for evaluation, accepting an offer, or using any service from The Gold ATM.

3. Message Frequency

Message frequency varies based on your inquiry and interaction with us.

Because this is primarily a conversational customer-service program, the number of messages you receive will depend on the nature and duration of your conversation.

4. Message and Data Rates

Message and data rates may apply according to your wireless carrier and mobile service plan.

The Gold ATM does not charge a separate fee for participating in its text-messaging program.

5. Opting Out

You may opt out of receiving SMS or MMS messages from The Gold ATM at any time by replying STOP.

After you reply STOP, we may send one final message confirming that you have been unsubscribed. No further messages will be sent unless you subsequently initiate a new conversation or take another valid step to resume messaging.

Where supported, you may reply START or UNSTOP to resume messaging.

7. Message Delivery

Wireless carriers are not liable for delayed or undelivered messages.

Message delivery may be affected by your wireless carrier, mobile device, coverage, service availability, or other circumstances outside The Gold ATM’s control.

Not every carrier or device supports every SMS or MMS feature.

8. Mobile-Information Privacy

The Gold ATM does not sell, rent, share, or disclose mobile telephone numbers, SMS opt-in information, SMS consent records, or text-message information to third parties or affiliates for marketing or promotional purposes.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Text-messaging originator opt-in data and consent will not be shared with third parties except as necessary to operate our messaging service, respond to your inquiry, prevent fraud, comply with applicable law, protect our rights, or respond to valid legal process.

9. Changes to These SMS Terms

We may update these SMS Terms periodically. Changes become effective when the updated terms are posted with a revised effective date.
